Terms of Service

1. Agreement

These Terms of Service are a binding agreement between you and MWGames ("MWGames", "we", "us"), a United States business that buys video game, trading card, and related collections from individuals and resells them, including on Whatnot. By creating an account or using mwgamestrade.com, mymwgames.com, or any related MWGames service, you accept these terms and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and accounts

• •You must be 18 or older, or have a parent or guardian complete the sale on your behalf.
• •You must provide accurate account, address, and payout information and keep it current.
• •You are responsible for everything that happens under your account and for keeping your password secure.
• •One account per person. We may suspend or close accounts for fraud, abuse, counterfeit items, or repeated non-shipment.

3. Offers and pricing

• •Offers generated on the site from PriceCharting data or your manual entries are estimates only until MWGames reviews the batch.
• •Once we approve an offer, the prices in it are guaranteed for 14 days from approval, or 30 days for active MWGames+ members.
• •We may adjust an offer after inspection based on condition, completeness, authenticity, or missing items. We show you the final amount before payment.
• •You confirm every item you send is yours to sell and is authentic. Counterfeit, reproduction, or bootleg items are paid at $0 and are not returned.
• •Items that do not work, smell of smoke, or have other disqualifying condition issues are subject to the deductions listed in the seller agreement.

4. Shipping and no returns

• •Batches ship with USPS using the prepaid label we provide. Do not use another carrier.
• •You have 3 business days after receiving your label to drop the package off and obtain a receipt, and you must upload a photo of that receipt to your account.
• •Shipping is free on approved offers of $50 or more. For batches under $50, the shipping cost is deducted from your payout.
• •Once a package is shipped to MWGames, the items become ours to process and are not returned for any reason.
• •Risk of loss passes to MWGames when the carrier scans the package into its network. Keep your receipt; without it, claims and payouts may be delayed.

5. Payouts

• •We pay by Cash App, PayPal, or Venmo to the handle you provide. You are responsible for the accuracy of that handle; we are not liable for funds sent to a handle you entered incorrectly.
• •Payment is typically sent within 3 business days of check-in and your acceptance of the final amount.
• •You are responsible for any taxes owed on amounts we pay you.

6. MWGames+ membership

• •MWGames+ is a paid subscription billed at $10 per month or $100 per year through Stripe, and it renews automatically until cancelled.
• •Members receive a +3% payout boost on eligible standard and strong tier items and a 30-day price lock.
• •You can cancel any time from your account; the membership stays active through the end of the paid period. Fees already paid are non-refundable except where required by law.
• •We may change membership pricing or benefits with at least 30 days' notice before your next renewal.

7. Text messaging (SMS) terms

By providing your mobile number in your MWGames account you agree to these SMS terms and consent to receive automated text messages from MWGames at that number.

• •Program: MWGames account and transaction alerts — offer ready, messages from our team, label issued, shipment received, deductions applied, and payout sent.
• •Consent is optional and is not a condition of selling to us or of any purchase.
• •Message frequency varies based on your batch activity.
• •Message and data rates may apply; your carrier's charges are your responsibility.
• •Reply STOP to any message to cancel; you will receive one confirmation and no further messages. Reply HELP for help, or email Matt@mwgameswhatnot.com.
• •You may also remove your phone number in account settings at any time to stop texts.
• •Carriers are not liable for delayed or undelivered messages, and deadlines in these terms (such as the 3 business day drop-off window) still apply if a message is delayed.
• •You confirm you are the subscriber or the customary user of the number you provide, and you will update or remove it if it is reassigned.
• •We do not send marketing or promotional text messages, and we never share your mobile number or SMS consent with third parties for their marketing.

8. Acceptable use

• •Do not submit stolen, counterfeit, or misrepresented items.
• •Do not scrape, overload, reverse engineer, or interfere with the site or its pricing data.
• •Do not harass other users, post unlawful or abusive content, or impersonate anyone.
• •Content you post (collection entries, messages, photos) remains yours; you grant us a limited licence to store and display it to operate the service.

9. Third-party data and links

• •Pricing and sales-volume data come from PriceCharting and are provided as-is; we do not guarantee their accuracy.
• •The site may link to eBay, Whatnot, Discord, and other third-party services governed by their own terms.

10. Disclaimers and limitation of liability

• •The service is provided "as is" without warranties of any kind, to the maximum extent permitted by law.
• •MWGames is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount of the offer at issue, or $100 if no offer exists.
• •Nothing in these terms limits liability that cannot be limited under applicable law.

11. Termination

• •You may stop using MWGames or delete your account at any time.
• •We may suspend or terminate access for a breach of these terms. Obligations relating to shipped items, payouts, and liability survive termination.

12. Changes, governing law, and disputes

• •We may update these terms; material changes are announced by email or in your account inbox, and continued use means acceptance.
• •These terms are governed by the laws of the United States and the state in which MWGames operates, without regard to conflict-of-law rules.
